Terms of Service
These Terms govern your use of all Proxykit services. By using our platform you agree to these conditions. Please read them carefully before purchasing or using any proxy plan.
1. Acceptance of Terms
By accessing or using any Proxykit service — including our website, dashboard, proxy network, or API — you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms of Service, our Privacy Policy, our Cookie Policy, and our Abuse Policy. If you are using Proxykit on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.
2. Service Description
Proxykit provides residential, datacenter, mobile, and ISP proxy services on a subscription or pay-as-you-go basis. Service availability is provided on a commercially reasonable "best efforts" basis. We target a 99.9% monthly uptime SLA for our core proxy infrastructure, as measured at our network edge. Maintenance windows and force majeure events are excluded from uptime calculations. We reserve the right to modify, suspend, or discontinue any aspect of the service with reasonable notice.
3. Acceptable Use
You may use Proxykit proxies only for lawful purposes consistent with our Abuse Policy. Permitted uses include web scraping of publicly available data, price comparison, SEO research, ad verification, brand monitoring, and market research. Prohibited uses include DDoS attacks, spam, credential stuffing, ad fraud, carding, distribution of malware, circumvention of legal geo-restrictions, and any other activity that violates applicable law. Violations result in immediate account termination without refund and may be reported to law enforcement.
4. Account Registration & Security
You are responsible for maintaining the security of your Proxykit account credentials, including your password and API keys. You must notify us immediately at support@proxy-kit.com if you suspect unauthorised access to your account. We recommend rotating API keys every 30 days and enabling two-factor authentication via Clerk. Any activity conducted through your account — by you or a third party using your credentials — is your sole responsibility. We will not be liable for losses resulting from unauthorised use of your account.
5. Payment, Billing & Refunds
All payments are processed by Paystack and are subject to their terms. By providing payment details, you authorise Proxykit to charge your selected payment method for the plan purchased. Subscription plans auto-renew unless cancelled before the renewal date. We offer a 24-hour refund window for technical issues that are demonstrably caused by Proxykit infrastructure failures and that we are unable to resolve. After this window, or where bandwidth has been consumed in excess of 10% of your plan allocation, all sales are final. Chargebacks initiated without first contacting our support team will result in immediate account suspension.
6. Intellectual Property
All content, trademarks, software, and technology comprising the Proxykit platform — including our dashboard interface, API, documentation, and brand assets — are the exclusive property of Proxykit and its licensors, protected by copyright, trademark, and trade secret law. You are granted a limited, non-exclusive, non-transferable licence to use our services solely as permitted by these Terms. You may not copy, modify, reverse-engineer, sublicense, or create derivative works based on our platform without our express written consent.
7. Limitation of Liability
To the maximum extent permitted by law, Proxykit and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, business opportunities, or goodwill — arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim shall not exceed the amount you paid to Proxykit in the 30 days preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Proxykit and its affiliates, officers, agents, and employees from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third party's rights, including intellectual property or privacy rights; or (d) any content or data you transmit through our proxy infrastructure.
9. Governing Law & Disputes
These Terms are governed by and construed in accordance with applicable commercial law. Any dispute arising under these Terms shall first be attempted to be resolved by informal negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration. Class action lawsuits and class-wide arbitration are waived. For users in the EU, mandatory consumer protection rights under local law are not affected by these Terms.
10. Modifications to Terms
Proxykit reserves the right to update these Terms at any time. We will provide at least 14 days' notice of material changes via email to your registered address. Your continued use of Proxykit following the effective date constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using our services and may request a pro-rata refund for any unused prepaid period by contacting support@proxy-kit.com within 7 days of the notice.
Notice to Enterprise & Reseller Customers
For resellers and enterprise clients on custom bandwidth plans exceeding 1TB/month or white-label agreements, additional Master Service Agreements (MSAs) and Data Processing Agreements (DPAs) apply. Contact our legal department at legal@proxy-kit.com for the full enterprise version of these Terms.
